These Terms of Service govern access to and use of ifxretrogames.com and purchases made through the website.

The website is operated by InternalFX, Inc., doing business as IFX Retro Games. By visiting the website, creating an account, submitting an order, or otherwise using the website, you agree to these Terms of Service.

If you do not agree, do not use the website.

1. Online Store Platform

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services.

Your purchase is made from InternalFX, Inc., doing business as IFX Retro Games. Shopify is a service provider and is not the seller of the products offered by IFX Retro Games.

2. Eligibility and Lawful Use

You may use the website only for lawful purposes.

By placing an order, you represent that:

You are legally capable of entering into the transaction.
The information you provide is current and accurate.
You are authorized to use the selected payment method.
Your purchase and intended use of the product comply with applicable law.

You may not use the website to commit fraud, interfere with security, introduce malicious code, scrape content without authorization, impersonate another person, violate intellectual-property rights, or engage in other unlawful or abusive conduct.

3. Customer Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate an account when reasonably necessary to protect customers, the store, or third parties; investigate suspected fraud; enforce these Terms; or comply with law.

4. Products and Availability

Retro gaming hardware, games, accessories, and components are often used, vintage, discontinued, collectible, repaired, refurbished, or modified.

Inventory may be limited to a single unit. Placing an item in a cart does not reserve it, and submitting an order does not guarantee acceptance.

We may limit quantities, discontinue products, correct inventory errors, or refuse or cancel an order before shipment.

If we cancel a paid, unshipped order, the applicable payment will be refunded.

5. Used, Refurbished, and Vintage Products

Unless a listing expressly states otherwise, products may be pre-owned and may show cosmetic wear consistent with age and prior use.

Condition descriptions are based on our reasonable inspection and testing. Vintage products may have variations, aging components, prior repairs, undocumented service history, discoloration, scratches, worn labels, or other characteristics that are not always detectable through ordinary inspection.

The product listing controls the specific condition, included items, work performed, modifications, region, voltage, and known cosmetic issues for that product.

Customers should review all photographs and listing information before ordering.

6. Product Photographs and Descriptions

We make reasonable efforts to present product information accurately.

Listings may use photographs of the exact product, representative photographs, or a combination of both. The listing should indicate when the exact photographed unit is being sold.

Colors and appearance may vary because of lighting, camera settings, display calibration, age, and normal product variation.

Typographical errors, technical errors, or incomplete information may occasionally occur. We reserve the right to correct errors before shipment.

7. Original and Replacement Components

Refurbished, repaired, restored, or modified products may contain replacement components.

Replacement parts may include capacitors, batteries, optical-drive components, screens, shells, cables, power supplies, fans, controller components, electronic components, or other parts.

Material aftermarket components and known modifications will be disclosed when reasonably relevant to the product’s use, value, or authenticity.

We do not represent that every component in a used or refurbished product is factory-original unless the listing specifically states that it is.

8. Authenticity

Products represented as authentic are offered based on our reasonable inspection and knowledge.

Reproduction, aftermarket, or third-party products will be identified as such when known and materially relevant.

9. Compatibility, Region, and Voltage

Customers are responsible for reviewing compatibility before purchase.

Compatibility considerations may include:

NTSC-U, NTSC-J, and PAL regions
Console and game region locking
100-volt Japanese equipment
Step-down transformer requirements
Television and display compatibility
HDMI adapters and video converters
Modifications
Memory cards and storage devices
Online services that have been discontinued
Third-party accessories
Game-specific hardware requirements

Do not connect imported or vintage equipment to an incompatible power source.

IFX Retro Games is not responsible for damage resulting from improper voltage, incompatible equipment, incorrect setup, unauthorized modification, or use contrary to product instructions.

10. Prices, Taxes, and Payment

Prices may change without notice before an order is submitted.

Applicable shipping charges and sales taxes are calculated during checkout.

Payment must be successfully authorized before processing begins.

We may cancel or hold an order because of failed authorization, suspected fraud, inconsistent customer information, pricing errors, inventory errors, or another legitimate operational or security concern.

If a substantial pricing or shipping-rate error occurs, we may contact you for approval of the corrected amount or cancel the unshipped order and issue a full refund.

11. Order Acceptance

An order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.

We may refuse or cancel an order before shipment for reasons including:

Inventory unavailability
Pricing or listing errors
Payment problems
Suspected fraud
Unsupported shipping addresses
Quantity limitations
Violation of these Terms
Legal or regulatory requirements
Other reasonable business or security concerns

12. Shipping

Shipping is governed by the Shipping Policy, which is incorporated into these Terms.

Delivery dates are estimates unless expressly stated otherwise.

Orders ship only to the address submitted with the original order. Address changes require cancellation, if still possible, and placement of a new order.

13. Returns, Refunds, and Cancellations

Returns, refunds, and cancellations are governed by the Return and Refund Policy, which is incorporated into these Terms.

IFX Retro Games does not offer direct exchanges or replacement orders. When another product is desired, the customer must place a separate order.

14. Custom and Special-Order Products

Custom-modified, made-to-order, special-order, and component-dependent products may require additional processing time.

Completion dates may depend on supplier availability, component availability, installation, testing, and other factors beyond our direct control.

Custom-modified and made-to-order products are not eligible for buyer’s-remorse returns, but this does not eliminate rights relating to defects, misdescription, or applicable law.

15. Repairs, Modifications, and Tampering

Opening, repairing, modifying, relabeling, or tampering with a product after delivery may affect return eligibility and any applicable warranty.

This includes removing or altering serial numbers, identification labels, security stickers, tamper-evident seals, or other identifying marks.

Nothing in this section limits rights that cannot legally be limited.

16. Warranties

Any written warranty offered for a product will be described separately on the product listing, warranty page, or accompanying warranty documentation.

Warranty coverage may vary by product type.

Except for an express written warranty and rights that cannot be excluded under applicable law, no statement on the website creates a warranty unless it is expressly identified as one.

Nothing in these Terms excludes or limits an implied warranty or other consumer right that cannot legally be excluded or limited.

17. Website Information

Website articles, videos, repair demonstrations, guides, compatibility discussions, and other informational content are provided for general informational purposes.

Electronics repair and modification can involve electrical shock, fire, property damage, data loss, and permanent product damage. Users are responsible for determining whether they have the necessary knowledge, tools, and safety equipment.

Website content is not a substitute for professional repair assistance when professional assistance is appropriate.

18. Intellectual Property

The website and its original content—including text, graphics, logos, photographs, videos, page designs, and branding—are owned by or licensed to InternalFX, Inc. and are protected by applicable intellectual-property laws.

You may not reproduce, republish, distribute, sell, modify, or commercially exploit our original content without prior written permission, except as permitted by law.

19. Third-Party Trademarks and Independence

Nintendo, Sega, Sony, PlayStation, Microsoft, Xbox, Atari, and other product names, company names, logos, and trademarks belong to their respective owners.

IFX Retro Games is an independent retailer and is not affiliated with, endorsed by, authorized by, or sponsored by those companies unless a specific relationship is expressly disclosed.

Use of third-party names is for identification, compatibility, commentary, resale, or descriptive purposes.

20. Reviews and Submitted Content

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to submit it and that it does not violate applicable law or another person’s rights.

You grant IFX Retro Games a nonexclusive, worldwide, royalty-free license to use, reproduce, display, edit for formatting, and distribute submitted content in connection with operating and promoting the business, unless otherwise agreed in writing.

We may remove content that is fraudulent, unlawful, abusive, irrelevant, misleading, or otherwise inappropriate.

21. Third-Party Services and Links

The website may use or link to third-party services.

We are not responsible for third-party websites, services, policies, availability, security, or content. Your use of a third-party service may be governed by separate terms and policies.

22. Disclaimer of Website Services

To the fullest extent permitted by law, the website and general website content are provided on an “as available” basis.

We do not warrant that the website will always be uninterrupted, error-free, or free from harmful components.

This disclaimer does not override an express product warranty, the Return and Refund Policy, or rights that cannot legally be waived.

23. Limitation of Liability

To the fullest extent permitted by law, InternalFX, Inc. and its officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or products.

To the fullest extent permitted by law, aggregate liability arising from a particular transaction will not exceed the amount paid to IFX Retro Games for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold InternalFX, Inc. harmless from third-party claims arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse or unauthorized modification of a product.

25. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, carrier disruptions, labor disputes, supplier failures, utility outages, internet failures, government action, civil disturbance, or similar events.

This section does not eliminate obligations to provide legally required delay notices, cancellation options, or refunds.

26. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

27. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

28. Entire Agreement

These Terms, together with the policies and product-specific terms referenced on the website, constitute the agreement between you and IFX Retro Games regarding use of the website and purchases through it.

29. Governing Law and Venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection law applies.

Subject to applicable law, legal proceedings arising from these Terms or a purchase through the website must be brought in the appropriate state court located in Johnson County, Kansas, or, where federal jurisdiction exists, in the United States District Court for the District of Kansas.

30. Changes to These Terms

We may update these Terms from time to time.

Changes will apply prospectively after the revised Terms are posted. The effective date appears at the top.
